ORDINANCE NO. 08-499
AN ORDINANCE AMENDING ORDINANCE NO.06-487, ESTABLISHING THE MONTHLY WATER, SEWER, AND GARBAGE RATES FOR THE TOWN OF DUSON. ALSO, PROVIDING FOR THE IMPOSITION OF A COLLECTION FEE FOR DELINQUENT SERVICE CHARGES OR USER FEES WHEN COLLECTED THROUGH THE OFFSET CLAIMS PROGRAM, AS AUTHORIZED BY L.R.S. 47:299.1 ET SEQ., AND TO PROVIDE FOR RELATED MATTERS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF DUSON, in regular session, that the following was offered by Gerald Alleman, seconded by Eugene Cahanin, and duly resolved and adopted on the 13th, day of January 2009.
BE IT FURTHER ORDAINED that Ordinance 06-487, which was adopted on January 9th, 2007, be hereby abolished. Therefore, Ordinance 06-487 is hereby replaced with Ordinance 08-499.
BE IT FURTHER ORDAINED that monthly garbage rates for all residential and commercial establishments be set as listed below based on cost assumes 3% CPI without CPI increase. Cost may include one pickup / week.
RESIDENTIAL AND COMMERCIAL GARBAGE RATES
RESIDENTIAL & COMMERCIAL - $ 20.00 per month
BE IT FURTHER ORDAINED that the monthly water rates for all residential and commercial establishments be set as follows based on the consumption of water;
RESIDENTIAL WATER RATES
0 to 2,500 Gallons- $8.75, plus
Over 2,500 Gallons - Additional $ 3.00 per 1,000 gallons or Portion thereof
COMMERCIAL WATER RATES
0 to 2,500 Gallons- $ 11.25, plus
Over 2,500 Gallons - Additional $ 3.00 per 1,000 gallons or Portion thereof
OUTSIDE WATER SALES RATES
$ 12.00 per 1,000 gallons or portion thereof
BE IT FURTHER ORDAINED that temporary water hookups for all residential and commercial establishments are $25.00 for 3 days only.
BE IT FURTHER ORDAINED that the monthly sewer rates for all residential and commercial establishments be set as follows based on the consumption of water;
RESIDENTIAL SEWER RATES
Flat fee per household- $.25 (“State Safe Drinking Water Program Management Fee”)
0 to 2,500 Gallons- $8.00, plus
Over 2,500 Gallons- Additional $ 3.50 per 1,000 gallons or portion thereof
COMMERCIAL SEWER RATES
Flat fee per commercial- $.25 (“State Safe Drinking Water Program Management Fee”)
0 to 2,500 Gallons- $9.75, plus
Over 2,500 Gallons- Additional $ 4.30 per 1,000 gallons or portion thereof
BE IT FURTHER ORDAINED that the establishment, known as the primary establishment, whether residential or commercial who allows for another establishment, known as the secondary establishment, to connect into their utility meter, will be charged the appropriate flat rate charge and will receive an additional flat rate charge for water, sewer and garbage for however many establishments connect to their line; plus $.25 LDH fees.
BE IT FURTHER ORDAINED that a late fee in the amount of $15.00 will be charged to any customer who pays water bill after the 21st of each month.
BE IT FURTHER ORDAINED that if services are disconnected due to nonpayment, a reconnect fee in the amount of $35.00 will be charged in order for services to be restored.
BE IT FURTHER ORDAINED that any charges levied herein which remain unpaid for 60 days past the due date shall be subject to collection through the Louisiana Municipal Advisory and Technical Services Bureau Corporation Offset Claims Program. Overdue charges will be offset from the individual income tax refund of the consumer. Should payment be collected through the Offset Claims Program, a fee of twenty-five dollars ($25.00) will be charged the consumer, in addition to all other charges, interest, and penalties collected. Pursuant to L.R.S. 33:361, the Agreement with the Louisiana Municipal Advisory and Technical Services Bureau Corporation for participation in the Offset Claims Program in the form attached hereto is approved, and the Mayor is authorized to execute it.
This ordinance shall become effective upon adoption of this ordinance.
This ordinance having been submitted to a vote in regular session assembled of the Mayor and Council of the Town of Duson, Louisiana the vote thereon being as follows:
YEAS: Gerald Alleman, Eugene Cahanin, and Dwayne Bowers.
NAYS: None.
ABSENT: Jimmy Champagne and Alvin Felix.
AND the said ordinance was declared adopted on this 13th day of January, 2009.
